The Texas Legislature has added the chapter to the Civil Practice and Remedies Code to limit liabilities for equine activities effective September 1, 1995.
Chapter 87 of the code says there is no liability for property damage or damages arising from personal injury or death of a participant in an equine activity, if the damages or injury results from a risk inherent in equine activities. Inherent risks include collisions with other animals, certain surface conditions, the unpredictability of an animal’s reaction to certain stimuli and potential of a participant and/or student to act in a negligent manner to an injury.
I hereby understand that Wild Heart Horse Ranch LLC and its employees and all other persons connected with Wild Heart Horse Ranch LLC are not to be held responsible for any injuries which I or my horse may incur at any event in which the horses may be used or while on Wild Heart Horse Ranch LLC property at 3120 FM 1995 Van Texas or as a result thereof.
